 Hi...
    Does anyone know if a DV lottery winner  was out of status in the US but went to Nepal and got the green card there through DV ? Because if you are out of status while in the states ..then USCIS deny the green card here. I have heard if you go back to nepal and apply from there...it will be approved. How true is this?? Any information related to this would be highly appreciated...

 that could be approved from Nepal unless you did any Crime, DUI when you were in the States.

If you did leave the country during 180 days grace period your good to go. If your still here forget about GC you'll be banned from US for at least 10 years.

 Thanks Guys. @Casino: I have overstayed the 180 days period ofcourse...but USCIS says i can go back to Nepal and apply from there then it won't be a problem. I am just not sure if they are telling me the truth and if the overstay is going to create a problem in Nepal's interview as well. So, i was just trying to see if anyone knew anyone who had been in the same situation. Some say it will work some say it wont....really confused on what to do .

Yes, its possible.  And,If you have a letter saying OK from USCIS, then thats the golden ticket, keep it with you.

My friend is a GC  holder n she has a child from a no paper guy. They don't live together but the guy pays child supports every month.

Once the guy selected for DV, he requested my friend to play a drama. That was his lawyers suggestion.

He stopped paying child support. The girl took him to the court. The judge said to him to pay child support, he explained he is illegal. He is not allowed to work. The judge can't force him to work and judge can't speak about his status because it is a civil court.

The guy requested to waive all the nonsense bar to USCIS, and  also showed the civil court judge's decision, added all the hardship. The guy went to Nepal and he is here today.

He is a good man. Now, he pays child support legally. Good for him, good for the woman, and best for the child.

So if you have drama in your life, use it.

If the USCIS people say such things then they're violating their own rule. Usually people who overstay visa are banned from entering US for at least 10 years. Why don't you consult a lawyer?

Don't take risk of going back to Nepal. U might be trapped inside no light zone since its getting summer, no more water in Kulekhani.
If I were u , I'd forget about DV, marry a girl, make her happy for 2 yrs and get on with my life or go to California n do what others r doing.

Thanks friends for the input....btw even the lawyer is not sure!! How amazing is that...lol anyways seriously i am really frustrated  and don't know whether or not to take the risk to go back and try from there!!  I will have to do some serious thinking now..maybe i should contact some other lawyers as well...

 Generally speaking Lawyers only speak what's on the US constitution. So, they are not aware of out of book situational cases. Unless, you find international lawyers with similar case experiences. Looks like none shaja users has  experiecnced such so far one has replied to your post. Therefore, take a risk and be an example for other in better or worse case senerios.  I am just saying, cuz if you dont' take chance when there, you don't get other such chances.
