Please help!!!! Currently i am with Indian consulting company and am working on a project. I am in H1B from that consulting company. Mero H1B expire hudaicha September ma. Mero consultating company le H1 B extension ki lagi file gardaicha... Mero Client le malai Job offer gardaicha ..i am worried ki maile Transfer garna pauchu ki paudina ? Purano company incase problem diyo bhane ke garne ? H1 transfer garda purano company sanga ke linu parcha ?  Ani if so maile CPT liyera garyo bhane huncha ki hudaina  ? Can you please suggest, any suggestion will be appriciated.

HI, there are two options in your case.

1. Accept H1B transfer to the current company who offer you the sponsorship and apply for the H1B extension, transfer and extension, both can be done at the same time. and while applying, go for premium processing so that you get your apprval withing 2 to 4 weeks. Never ever go for general , it might takes more than 5 months and by that time your curent H1B status will be in pending and cause lots of other legal and technical problem like driving license can not be renewed, and others.

2. Apply for the H1B extension in premium from the Indian consulting firm and once approved, transfer to the current company any time.

In my opinion, first option is the best one, however, talk to your lawyer for the best result. Keep in mind, go for premium processing, otherwise you have to wait for 5-6 months for approval and while applying for the extension, provide all the documents necessary. Getting extension is tough these days, so your lawyer should file with proper supporting documents. All the best my friend. If you need any further details, you can send me  email in sajha.

Mero arko concern ke ho bhane...mero consluting company le es ma kehi ta garna paudaina ni meaning they can't stop me rigth ? tyo company bata ke linu parcha ? please suggest me.

As long as other compnay is reay to sponsor you under valid H1B, thee should not be any problem in the H1B transfer. The current consulting firm can not do anything or hold your H1B for nothing, H1B is just a sponsorship to work, not a contract. In fact, job contract as such done by the so called consulting firm for their own benefits is illigal and void in US, and no need to worry even if they asked you to do contract while applying for the H1B. So go ahead with the extension and yes, ask your consulting firm to provide you the original of the H1B approval document from USCIS (which they normally do not provide you, in that case you can apply to the USCIS for a copy of it, but you should know your EAC number). Hope this works.
