Is this your first time H1-B stamping? Or you previously had it stamped from Nepal?

Yeah, this is my first time H1B stamping. I donot think it will make any difference whether you are doing for the first time or second time. May be first time stamping will take little longer time for PIMS verification.

Neerman-ji are you a direct hire or is it EVC(employer-vendor-client) or EC(Employer-client) style hire ? How long have you been in H1b ? I just got my H1b and I wanted to go for stamping as well but really confused and kinda scared what if visa is rejected. What happens if visa is rejected ? can we come back to Usa again and start working ? I have heard and read in couple of forums that there is a loophole that can let you get into usa with in 30 days of visa stamping rejection, is it true?

hi Rudrey, you can enter Canada or Mexico for 30 days (max) and enter the US without a visa if your visa has expired. all you have to do is not hand over your i-94 when you enter Canada/Mexico. keep it safe with you. I-94 is your ticket back to the US.

but if you apply for a visa in Canada/Mexico, situation will change. the above situation will no longer apply. if you get rejected for a US visa, you have to fly back to Nepal from there.

Mine is a direct hire model and have been working for this employer for the last 5 years.
I heard that if you are working under EVC(employer-vendor-client) or EC(Employer-client) style , then all you have to do is prepare 'proper documentation', I guess that shows clear understanding of the projects you have done. Its better to consult with Lawyer in that case to prepare proper documents.If the employer is genuine, if the project you are doing is genuine and the client is genuine, then there will not be any problem, I guess. So proper documentation is the key before taking any risk of going to H1B stamping to Canada or anywhere.
My suggestion is "If you are confident about your documents, go ahead, it might takes longer but you will definitely get it. OW never ever try to take this stupid risk." I still remember my lawyer saying, "Donot go to Canada or else just for H1B stamping reason, US embassy feel irritated as you came to Canada just for H1B stamping and no other reason. ", so I donot know, I wanted to get it done soon and I decided to go CA. So, sometimes we have to take risk to get things done.
