काठमाडौं- अख्तियार दुरुपयोग अनुसन्धान आयोगले अखिल नेपाल फुटबल संघ (एन्फा) का अध्यक्ष गणेश थापाविरुद्धको भ्रष्टाचार अभियोगसम्बन्धी अनुसन्धान स्थगित गरेको छ। थापाविरुद्धको उजुरी अख्तियारले तामेलीमा राख्ने निर्णय गरेको छ।


एन्फाकै पदाधिकारीले लगाएको भ्रष्टाचारको अभियोगलाई संसदको सार्वजनिक लेखा समितिले सदर गरेपछि थापा आफ्नो पद स्थगन गर्दै फुटबलका सबै गतिविधिबाट अलग रहेका थिए।

लेखा समितिले असोज १२ गते एन्फामा ५८ करोडभन्दा बढी भ्रष्टाचार भएको ठहर गर्दै अध्यक्ष थापासहित चार पदाधिकारीको दुई महिना पद स्थगन गरी छानबिन गर्न निर्देशन दिएपछि अख्तियारले अनुसन्धान थालेको थियो।

'एन्फाका सम्बन्धमा परेको उजुरी तामेलीमा राख्ने निर्णय गरिएको छ,' अख्तियार प्रवक्ता बेगेन्द्र पौडेलले बुधबार नागरिकसँग भने, 'थप प्रमाण फेला परे फेरि फाइल खुल्न सक्छ।'

अख्तियारबाट तामेलीको पत्र पाएको पुष्टि गर्दै एन्फा अध्यक्ष थापाले न्याय पाएको बताएका छन्। 'फुटबलमा कुनै अनियमिता नभए पनि कानुनभन्दा माथि कोही हुन्न भनेर हामीले छानबिनमा सहयोग गरेका हौं,' उनले भने, 'छानबिनपछि कुनै अनियमितता नभएको प्रस्ट भएको छ। मैले न्याय पाएको महसुस गरेको छु।'

लेखा समितिको निर्देशनअनुसार राप्रपा नेपालको तर्फबाट संविधानसभामा प्रतिनिधित्व गर्ने सभासद थापाले कात्तिक ३ गते पत्रकार सम्मेलनमार्फत दुई महिना पदबाट अलग रहेको घोषणा गरेका थिए। त्यसपछि कात्तिक १८ मा उनले चार महिनाका लागि फुटबलसम्बन्धी राष्ट्रिय तथा अन्तर्राष्ट्रिय गतिविधिबाट आफू अलग भएको फिफालाई जानकारी गराएको फिफाको वेबसाइटमा उल्लेख गरिएको थियो।

एन्फा उपाध्यक्ष कर्माछिरिङ शेर्पा लगायत पदाधिकारीले एन्फा र अध्यक्ष थापाविरुद्ध लेखा समिति र अख्तियारमा उजुरी दर्ता गराएका थिए। थापासँग बयान समेत लिएको लेखा समितिले एन्फामा भ्रष्टाचार भएको ठहर गर्दै अख्तियार, युवा तथा खेलकुद मन्त्रालय र सम्पत्ति शुद्धीकरण विभागलाई थप छानबिन गर्न निर्देशन दिएको थियो। थापाले सबै आरोप अस्वीकार गर्दै आएका थिए।

यसैबीच अख्तियारले राष्ट्रिय खेलकुद परिषद् (राखेप) मार्फत एन्फा अध्यक्ष थापालाई सचेत गराएको छ। अख्तियारबाट पत्र प्राप्त भएको स्विकार्दै राखेप सदस्यसचिव युवराज लामाले आर्थिक नियमावलीका विषयमा सचेत गराउन उल्लेख गरिएको बताएका छन्। उनले भने, 'पत्रअनुसार केही दिनपछि एन्फालाई निर्देशन दिनेछौं।'

एन्फालाई अख्तियारको निर्देशन
अख्तियारले एन्फालाई तीन महिनाभित्र लागू गर्नका लागि पाँच बुँदे निर्देशन गरेको छ। अख्तियारले एन्फालाई खेलाडी कल्याण कोष कार्यविधि, आर्थिक नियमावली, कर्मचारी विनियमावली बनाएर लागू गरी जानकारी गराउन निर्देशन दिएको छ। यसैगरी विदेशी प्रशिक्षकको सवारी र घरभाडामा लिँदा सार्वजनिक सूचना वा कोटेसनमार्फत प्रतिस्पर्धाका आधारमा मात्र गर्न र प्लस वानसँग फुटबल खरिदका लागि १० हजार डलर पठाए पनि अहिलेसम्म बल नआएकाले तत्काल फुटबल ल्याउने वा पैसा फिर्ता ल्याउन निर्देशन दिइएको छ।

All of these politicians have no shame or conscience. What a terrible quagmire for the common Nepali.

अस्ति भक्कर अख्तियारमा माओबादी र कंग्रेस्सको मान्छे हरु भित्रौनेमा सम्झौता भयो भनेर समाचारमा आयो. CIAA is one entity that should absolutely be devoid of any political affiliation. If the program is not setup right, how can execution be acceptable?

If the operating system inside these constitutional bodies is good, appointment based on party allocation is ok. It can function well as long as the appointed members are generally 'ok'. It will be really difficult task to get a "100% clean man". In the past, even some of the supreme court chief justices had questionable past, but as they got to the position, they have maintained their "सम्माननीय" status.

Same thing is happening in public service commission (lok sewa). Even if the members and chairman are appointed according to party allocation, they have maintained its image of 'impartial' commission. The working procedure (karyabidhi) is made in such a way that no one can go against it unless they are unanimous.

Back to CIAA, if there are 5 commissioners (including chief), when it is time to decide on proposals/cases prepared by legal team of government attorneys hired consultants, the chief participate only if there are 2-2 on each side. And, each commissioner (and chief) who have already achieved a higher level of position in public or private sector will feel hesitant to propose in the commission meeting to withdraw a case (or proceed with a case) if the case clearly lacks supporting proofs.

You have a point nepalilaure; although I wouldn't put CIAA in similar observation as Lok-Sewa. The closest could be Superme court system - even in US, presidents get to nominate (confirmed by Senate) Supreme court, Court of Appeals and District court justicees/judges. This is primarily for checks and balance measure between the three entities.

However, CIAA's main point of focus are Government workers and the Government itself - although CIAA has announced that they are moving towards private entities. With that in mind, how can you expect an entity to do its due job if the people it needs to investigate control the power to form this very entity? It's akin to police department being filled with cops that thieves handpick.

CIAA should absolutely have no ties to political leaders is my point. However, I understand your point that under the current system, it actually is normal. Perhaps we should reject the normal as it hasn't been working. Ineptness is not just in the people, but in the program itself.

Ok, lok sewa and CIAA are not perfectly comparable when it comes to functioning. But, i just wanted to give an example that party allocation (please note, NOT affiliation) can work even in constitutional bodies.

लोक सेवामा काम गर्ने मान्छेले भन्छन "त्यहाँ भित्र सिस्टम येति कडा छ कि चोर लाइ नै सदस्य बनाएपनि केहि गर्न सक्दैन" \ तेसैले त ४६ साल अगाडिको र ४६ साल पछाडिको लोकसेवामा केहि फरक छैन , जबकि ४६ साल पछि कुनै न कुनै रुपमा पार्टीले पत्याएको मान्छे नै नियुक्त हुदै आएका छन् \

CIAA is different in the sense that working procedure is not as clear as lok sewa. There always remains discretion in deciding whether to file a case or not, and in setting priority.

About the ties to political leaders. I believe even the members who used to get appointed before 2062/63 also had ties to the party or leaders, but if the proposed name get questioned by a single member he/she would be dropped. अहिले चै three parties propose the names which should be accepted without questions.

Kiddo, It may sound i am disagreeing to your points, but i believe that if commissioners have courage they can function well even after getting appointment through party allocation. CIAA is really a powerful body, as powerful as Supreme Court. If you look at supreme court justice Sushila Karki (who was appointed at the recommendation of Bar Association- i believe enough politics was there),whose father, husband all are big time congress stalwarts, wrote a final verdict (that can't be appealed anywhere) against JP Gupta (minister that time, and a good kangress man previously) and Khum B Khadka, influential kangress leader. If she had wanted, she would have easily avoided the case.

ps. I am not against a provision of some non-political council to do the job that present Constitutional Council doing now. That council can consist of two living former chief justices, current chief justice (or seniormost judge next to chief justice) and one another person proposed by government and approved by parliament. Something, that they had recently formed to recommend names for Human Right Commission. But, the thing is that none of the parties will agree on such provision, not even madeshi parties, let alone big three.
