Hello

I paid indian consultancy to file for H1b but didn't get selected in lottery. Now, those people are making so many excuses and not returning my money. I am still working through them. When asked for the money they will say "next month, next month" and don't return my money.

In my paycheck they deducted that amount as a "Loan deduction". However, I have a text from CEO saying that I need to pay for h1-b.

What is the best way to get my money back? If I have to complain to whom I should be complaining?

please help

Asking employee to pay for H1B filing is illegal in US. If you have a solid proof and want to sue them, you can do in the court of law. Before that, to avoid any lay-off from current company as you are working under H1B, transfer the H1B to any other company first and sue the first one if its a big amount. Otherwise, remember once you are in lay-off, after few weeks of grace period, you will be out-of-status. Think wisely.

@neeraman, he is not on H1b. He is filing H1B but not selected lottery.

Thank you for your reply. I am not on H1b, i am in f1 and working through CPT. If I complain about them will that put me any trouble beause I paid for h1? As I said I have text from their CEO that I need to pay for h1b. I do not want to sue them rather complain about their improper business practices.. Whom should I complain about it ?

I really appreciate your help.

You will not be in problem because you paid for h1, but you might be in problem if your employer finds you that you complained against them. Your company will be in problem for making you pay for h1. You would definitely get back your money if you follow all procedures for complaint and if you have proper proofs. You should be prepared to face the situation if your company fires you coz any company can terminate employees for no reason.
