Dear country men can you tell me if there is Birthright in USA? The Citizenship Clause of the Fourteenth Amendment states that U.S. citizens are all persons born or naturalized in the United States and subject to the jurisdiction thereof. The case: A Nepali woman travels to US on a visitor ( nonimmigrant) visa and gives birth on US Soil now will the child automatically gets a US citizenship? And what about the visitor Mother will she also garnted a residency permit? Please put some light on this matter. Thanku.

The child is a natural born citizen but the mother get's nothing! The child has the right to live in the U.S etc and can sponsor the parents when the child reaches age 18 but not before that. In many cases such as this, the child is taken back to the home country (here Nepal) and then chooses AMerican Citizenship at age 18 (Nepal does not allow dual citizenship) and can then sponor parents. It's a long winded illogical process but it is what it is.

If mother decides to stay with the child saying conditions back in country in not favourable, they will not be forced out. One parent can stat in the USA. I know it for sure.

I can fly: In order to do that i.e. petition to remain in the U.S with a U.S born infant and be successful one has to prove "extreme hardship" to the infant if returned to the home country. I wish I could tell you what a successful application on grounds of "extreme hardship" constitutes but I doubt even the INS has a clue. A lot of these decisions are very arbitrary. You could try and show that the political scenario are horrible; that the education system as it stands will leave this U.S Citizen child at a disadvanatge when he/she returns to the U.S...but, the fact is that even these issues are likely going to be dismissed..you can certainly try and make the case but, please keep in mind that it likely going to take a while before you recieve favourable response.

In real context, Yes, you will have brith Rights in USA. But..... If you are white, your rights is 100%. If you are parents other country like Asia, Africa, South America, East Europes.... , Your brith rights is 70% only. You are become 2nd class citizen by your skin and outlooks.
