Namaskar,

The present scenario in Nepal and the political instability seems to get worse day by day. Innocent Nepalese are being openly threatened and terrorized by the Maoists on one hand and the Government on the other by suppressing the popular peaceful movement of political parties. If you are/were/fear torture from the Maoists if you go back to Nepal or if any of your family member has been threatened in writing or in any other measurable way you are eligible for asylum status in the US. If you were member of sister organization of a political party (except for any communist parties) and are/were/fear torture or threat from the government, you are eligible for asylum status in the US, leading to a permanent residence in near future.

We are organizing an interaction for Nepalese asylum seekers on May 12th or 13th in San Francisco, California. We will have a speaker on Asylum Law, an experienced asylum attorney, Mr. Bill Kadarusman, for free consultation.

If you are interested please let me know and pass this information to anyone you know who is need of consultation and wants to attend or even share their success/pending/rejection stories. We are looking forward to meet as many asylum seekers we can so that we can assist then in attaining their goals right away.

At the present scenario of Nepal, we assume that asylum status will be granted to all Nepalese in the US, if applied on time, in a proper manner and through appropriate representation. We may be able to help you regardless of your status, period of stay and wherever you have been residing or working in the US.
If you cannot attend the session just because you are unable due to work or residency in another state, please let me know and we will forward you with the information we have gained. If there are significant numbers of Nepalese in need of asylum in another state, we may be able to arrange an interaction in your state too.

Asylum should be applied within one year of your last visit to the US. If you are in a situation, where you have exceeded the one year limit, you may still have chance to file given proper filing procedure and by producing evidences.

For your information;
•Asylum may be granted to people who are already in the United States and are unable or unwilling to return their home country because of persecution or a well-founded fear of persecution on account of race, religion, nationality, membership in a particular social group, or political opinion.
•If you are granted asylum, you will be allowed to live and work in the United States. You also will be able to apply for permanent resident status one year after you are granted asylum.
•No limits are set on the number of individuals who may be granted asylum in the United States.
•To be eligible for asylum in the United States, you must ask for asylum at a port-of-entry (airport, seaport or border crossing), or file an application within one year of your arrival in the United States. You may ask later than one year if conditions in your country have changed or if your personal circumstances have changed within the past year prior to your asking for asylum, and those changes of circumstances affected your eligibility for asylum.
•You may also be excused from the one-year deadline if extraordinary circumstance prevented you from filing within the one-year period after your arrival, so long as you apply within a reasonable time given those circumstances.
•You may apply for asylum regardless of your immigration status, meaning that you may apply even if you are illegally in the United States.
•Asylum applicants can apply for employment authorization after wait 150 days after filing for asylum.

Please contact for more details and confirmation of date, time and venue of the interaction program. You can also write to me in details along with your documents at the following address:

I know people may be sick and tired of seeing this mesage, but it is a HUGE problem in Immigrant Communites and the Nepali Community in the U.S are primt targets for Immigration Fraud: BE CAREFUL

The following message appears on several threads on Political Asylum. Please people, be careful. This is a serious issue with the Nepali community and you need to be aware!

This may be improper on my part and what I have to say below is not an attack on your desire to help the Nepali community but as a Nepali and someone who is aware that there are many who are working overtime to make fools of the Nepali community with all manner of promises, I have to say the following:

For those of you that frequent this forum and may be considering applying for asylum based on the circumstances back home, please be very careful about the attorney's you choose.

As a current law student and someone who has worked in the Nepali community with lots of Nepalese who have been taken to the cleaners by unscrupulous attorney's..please make sure that you know the attorney's history and track record before you hire them to represent you.

Political Asylum is NOT an easy application to make. There a lot of requirements that have to be fulfilled. First of all, applications have to be made within a year of entering the United States and the applicant has to be able to show a fear of persecution or a well founded fear of persuction to them (meaning, you cannot show that becuase you or your cousin is a mamber of the Congress, Communist or even KG's cabinet for that matter, your life is at risk. You have to show that your own Religious, Political, Social Group or National Origin put you at a risk in Nepal)

The consequences of a failed application are sever - deportation is every possibility and yes, you can appeal the decision of the Immigration Judge but the appeal is a very lenthy and expensive process.

I am not telling you to NOT apply, all I am saying is BE CAREFUL!...there are a lot of attorney's who have no concerns about charging am nuch as $3000 for an application and you should not become a victim.

In response to Mr. Giri,

The only way, a person who has been in the U.S for more than a year can apply for Political Asylum is by showing that there are "changed circumstances" in the home country which make it dangerous for you to return.
YOu, the applicant have to be able to show that you have either faced perseuction in the past as a result of your Religious or Political Beliefs or becuase of your membership in a particular social group, Political Group etc. It is necessary for you to show that YOU have faced or will face persecution. You cannot show that your family's activities is a risk for you.

Secondly, getting a work permit is NOT a sign that you have been granted asylum. All a work permit allows you to do is work in the U.S. It is advisable that you not travel anywhere till you have definitive word. If travel in necessary then apply for a Parole visa so you can leave and re-enter..again, speak to an attorney with experience on this iisue.
********
Again, Please be careful of the attorney you choose. There are many who claim to have lots of experience and charge as much as $3000 for a single application.

What nepaali has says is totally true. I have also met victims of such circumstances.
I WANT TO CLARIFY HERE THAT;

THE INTERACTION IS ONLY INFORMATIVE IN NATURE, WE WILL ALSO HAVE GUEST PEAKERS SUCH AS PROFESSORS AND OFFICIALS IF POSSIBLE. THE PROGRAM WILL BE HELD MOST LIKELY IN A UNIVERSITY.

ATTENDING THE PROGRAM DOES NOT FORCE ANYONE TO BECOME A CLIENT.
