Hi Everyone,

I am currently in Nepal. I have F1 visa. I already have H1 but need to get H1-B visa in Nepal.

Do I also need to get clearance from Ministry of Labor to fly back to USA ? If yes, what about H4. I am not sure if H1-B is also considered as foreign labor.

Please let me know.

Yes, you will need to get a permission (stamp on the back of your passport) from Ministry of Labor for H1B. I am not sure about H4. You can check when you go to the office which is located in Teku.
It is a ridiculous rule, neverthelsess.

Yeah. It doesn't make sense.

What is the office called ? Is there Ministry of Labor.

It is the office in Teku, I think it is department of labour or something. They require you to have life/health insurance, mediacal/blood reports etc.. If you are in a hurry, there are people outside; they will prepare all the papers you need for about NRS 1000, ( That was the rate about 6 monts ago ;) Take some passport size photographs with you.

Do you need to have H1B stamped in your passport or you can take H1 papers only. My visa appointment is later in the week.

Do I need health/life insurance card. I don't have it with me in Nepal.

If I don't get stamped, will they stop me in the aiport.

I think You have to have visa stamped; not 100% sure

They don't really care if you have insurance stuff from here, they want it from there, you can make that stuff outside the office.

About getting stopped in airport, they say they will, but they really did not look for the labor dept stamp in airport in my case - I think it is better not to take a chance knowing KTM airport officials

You need to go there after you have a visa.
And do not take any chances againts crazy nepali officials by going to the airport without the permission, you may regret.

The office is called "Shram Beevag."
