Maoists continuing atrocities; tortures one on the charge of polygamy

Notwithstanding their commitment to stop atrocities against general people and public commitment of the Maoist supremo Prachanda to stop the people’s courts in urban areas, Maoists abducted and tortured a person for three days in the charge of polygamy.

The Maoists on June 21 brutally tortured Ram Malla, son of Bishnu Kumari Malla of Ghodaha in Devdaha-7, at their 'peoples' court' for a second marriage. Malla and his mother Bishnu Kumari said the Maoists threatened to kill them if they disclosed the fact to the media, the Kantipur Daily reported.

Ram is undergoing treatment in Universal Teaching Hospital in Bhairahawa since two weeks.

Ram married for the second time after his first wife refused to stay at his house for six years after the marriage.

The family members of first wife had filed a petition at the Maoist court demanding action in the case of polygamy.

Though doctors had advised him to go Kathmandu or other places for treatment, he is undergoing treatment in Bhairahawa due to the lack of money. He is undergoing treatment in the neurology and psychology department of the hospital.

The Maoists had also summoned his second wife to attend the people's court and warned that she has to join the people’s liberation army if she did not appear before the court. She however, defied the order and is staying at her mother’s home.

However, Kantipur daily said that the district level committee of the Maoists has assured to investigate the case and punish the culprits.

When contacted by Nepalnews, a member of the Maoist negotiating team, Dinanath Sharma, said his party did not have the policy of perpetrating torture against anybody and that the policy would continue in the future as well.

He further said that they will investigate the incident and if it was done by the Maoists, appropriate action will be taken against those found guilty in the incident.

He however acknowledged that there are some elements in the party, who are taking action against people due to their personal ego, which is causing harm to the party and movement. He informed that some party cadres are already in detention for doing so.

Sharma further said that some people are collecting donations in the name of Maoists and added that they are searching such people to expose their wrongdoings.

This action of Maoists comes after Maoist Supremo Prachanda said he has directed his party's district units not to operate "people's courts" in the capital and urban centers for the time being.

Issuing a press statement on July 3, the Maoist supremo said his party had taken the decision "keeping in view of the gravity of the situation and also to facilitate the on-going peace negotiations and the process towards peace and forward movement."

Talking to Nepalnews, Sailendra Guragain, Director of the Centre for Victims of Torture (CVICT), an NGO campaigning to eradicate torture from the country, said that they will study the incident and take necessary action.

काभ्रे, असार २१ -
सेनाद्वारा डेढ वर्षअघि हत्या गरिएकाको चिहान फेला परेको छ । मानव अधिकार आयोगको विशेषज्ञ चिकित्सकसहितको टोलीले चलाल गणेशस्थानस्थित सल्ला फेदको जंगलमा चिहान खनेर कपडासहितको कंकाल बुधबार निकालेको छ ।
शव फूलबारी गाविस-८ लकाइनेका ३७ वषर्ीय हरि बोलखेको हुन सक्ने आफन्त र स्थानीयवासीको अनुमान छ । २०६० पुस १२ मा प्रहरीले उनलाई बनेपाबाट पक्राउ गरेको भोलिपल्ट सैनिक ब्यारेकमा रहेको जानकारी परिवारले पाएका थिए । सोही दिन धुलिखेलस्थित शत्रुमर्दन गुल्ममा हरि रहेको एक सिपाहीले परिवारजनलाई बताएका थिए । उनलाई माओवादीको आरोप लगाइएको थियो ।

पक्राउको केही घण्टाअघि हरिलाई भेटेका मधुसूदन सत्यालले भने- 'रातो ज्याकेट र जुत्ता हेर्दा हरिकैजस्तो छ ।' खनेर निकाल्नुअघि हरिले रातो ज्याकेट लगाएको उनले बताएका थिए । पक्राउको दिन काठमाडौंको एक चर्चका पास्टर हरि १३ गते क्रिस्मसका लागि बनेपा आउँदै थिए । कोटेश्वरमा सँगै चिया खाएर हिँडेका उनी बनेपामा पक्राउ परेको मधुसूदनले भोलिपल्ट सुनेका थिए ।

गस्तीको सैनिक टोलीले २०६० फागुन ४ मा एक व्यक्तिलाई त्यो क्षेत्रमा हत्या गरेको स्थानीयवासीले बताए । सेनाले चारैतिर घेरेर अन्धाधुन्ध फायरिङ गरेका थिए । 'म पाखामा घाँस काट्न गएको थिएँ । गोली चलेको आवाज सुनेकी थिएँ,' स्थानीय तीर्थमाया तामाङले भनिन् ।

उनको घरबाहिर रहेको कोदालो र सावेल सेनाले लगेका थिए । त्यतिखेर तीर्थमायाको घरमा केटाकेटी मात्र थिए । 'एक, दुई पाहुना घटायौं भनी सेनाले गाउँलेलाई सुनाएका रहेछन्,' तीर्थ मायाले भनिन् ।

स्थानीय रामकृष्ण श्रेष्ठ घटनाको दिन बसमा पनौतीतर्फ आउँदै थिए । सेनाले यात्रुलाई ओरालेर सोधपुछ गरेको उनले बताए । 'सेनाले बस रोकेको बेला सल्लेफेदतिर गोली र बम पड्केको थियो,' रामकृष्णले भने- 'सेनाले कसैको हत्या गर्‍यो भन्ने अनुमान गर्‍यौं ।'

सैनिकहरू ढुंगेखर्क र चलाल गणेशस्थान डाँडाबाट तीनतिर बाँडिएर झरेको स्थानीयवासीले बताए । सँगै रहेका हरिसहित तीन बन्दीलाई उनीहरूले प्रत्येक समूहमा राखेका थिए । हरिलाई सल्ले फेदको डाँडाबाट, एकलाई खोल्साबाट र अर्कोलाई मूल बाटैबाटो ल्याएको तीन बन्दीमध्ये रामप्रसाद सुवालले अधिकारकर्मीलाई बताएका छन् ।

पनौतीस्थित ब्यारेकबाट तीन बन्दीलाई सेनाले सर्चमा जाने क्रममा लगेको बन्दीले बताएका छन् । चार दिनसम्म विभिन्न ठाउँ घुमाउँदै सेनाले त्यहाँ ल्याएका थिए । 'फर्किंदा दुई जना मात्र थियौं । हरि थिएन,' सुवाललाई उद्धृत गर्दै एक अधिकारकर्मीले भने ।

कंकाल निकालेपछि टोलीका विशेषज्ञ चिकित्सक डा. हरिहर बस्तीले भने- 'लोग्नेमान्छेजस्तो देखिने कपडासहितको लास फेला परेको छ । अरू केही भन्न सकिने अवस्था छैन ।' उनी सँगै डा. प्रमोदकुमार श्रेष्ठ थिए । आयोग सदस्य सुदीप पाठक पनि टोलीमा थिए । धादिङ र कालिकोटपछि आयोगले यहाँ चिहान खनेको हो ।

असिनपसिन गर्दै साढे दुई घण्टापछि अधिकारकर्मी र चिकित्सकले शव निकालेका थिए । बाटामाथि भिरालो जंगलमा चिहान खोतलेको हेर्न केही स्थानीयवासी पनि आएका थिए । यो स्थानीय राजकुमार तामाङको निजी जंगल हो । घटनास्थल पनौतीबाट करिब दस किमिदक्षिण पश्चिम पर्छ ।

प्रायः काठमाडौं बस्ने पति हरि पक्राउ पर्नुभन्दा चार दिनअघि मात्र घरबाट निस्किएको उनकी पत्नी ज्ञानीदेवीले बताइन् । उनीहरूका तीन छोरी र एक छोरा छन् । 'आफन्तबाट ऋण गरेर व्यवहार चलाउँदै छु,' घरमै पुगेका सञ्चारकर्मीहरूलाई ज्ञानीदेवीले भनिन् । निर्दोष रहेकाले पतिलाई छाड्न उनले आग्रह गरिन् ।

२०६१ असोज २६ गते गृह मन्त्रालयले १ सय २६ जनालाई सार्वजनिक गरेकामा हरिलाई सैनिक हिरासतमा रहेको बताएको थियो ।
