I currently am under H1B working for a non-profit organization, which is quota-exempt. I am very unsatisfied with this job and am looking to get another job at a different company. but what i heard is that you cannot change from a quota-exempt job to a quota-job (commerical job). to do that you have to wait till april and file new H1B under the quota.

i am really stressed out because of this since i desperately want to leave this job but if i cannot change by H1B, then i will be stuck with this job for a long time.

if anyone of you have a good idea on how this works, please reply. thanks a lot in advance.

There are pros and cons.
An employee of a Nonprofit gets his/her Greencard porocessed much fater compared to others.
The H-1B transfer thing, you have to wait until April 2007 quota, as far as I know.

You must wait until the quota is available in April 2007. I think quota for advanced degree has also finished. I was having the same problem. I had a job offer and I couldn't take the new job because my H1B from the current non-profit org didn't get transferred, so I missed the opportunity.

I don't think green card process from non-profit organization is faster if you're applying on EB.

Thanks guys. I confirmed with my lawyer and this is true.

This sucks big time. He also told me that not only do i have to wait till April 07 to file, but i cannot work till October 07. is this true? if i do premium processing at the start of April and get approval within 2 weeks, shouldn't i be able to work since i ALREADY had a H1B to start with?

this is some serious horsemanure law that needs to be taken care of.

@Santoshgiri:
why do you think going for GC from Non-Profit is faster?
I have a Masters degree and would fall under EB2, and if the GC process is faste (i hear less than a year), i would go for that. But i need some realistic dates or else i would be stuck with this employer where i do not want to work for the time frame of the GC application.

TO qualify for EB-2, your job also should require Masters Degree. And your prevailing wage too. I heard that Bachelors Degree and 5 years work experience can also be eligible for EB-2.
