this is not a pre-mediatated murder, a term described in criminal proceedure as some murder that was pre-planned, where he could be charged for first degree. if the person is charged, they will charge him for manslaughter/involuntary manslaughter, and a grand jury can indict him for at least 4 years. depends on how the prosecutors wanna go with the charge.

That is not his business to save other's propery killing. If that happend to his own property, law has given right to shoot.
