My petition for H1B visa was recently approved. I am currently in a F1 status (Non-OPT). I would like avoid registering for fall classes and wasting a semester worth of fees (which I cannot afford anyway) just to maintain my status until October. What are my options? Please advise.

Your Grace period of around 60 days should cover it, don't you think so? I suggest you do a bit research on this. This might help you to avoid taking classes for fall and save some.  Good Luck.

Hi Oleg Polanski,

I am in the same situations and what I advice to do is....You have to enrolled to maintain your status....what I did is I took 2 online second week class and one 16 week in class and in Oct. I will drop 2 of my online classes...I will get my money refund ASA I drop those classes and you  can also drop other one too but I prefered to take 16 week class as I already paid for it.

I think this will help.....

from what I know, the H1B rules were tweaked last year(?) so that people who got their H1B approved will not be deemed out of status even if their current status was set to expire before October 1st (H1B start date every year). someone please verify this.

Also, like Poon-hill stated, the 60 days grace period should cover it, even if what i said above was not true. confirm with a reliable source (best bet is the USCIS website www.uscis.gov  or the instruction pdf for H1B application).

Only if someone's h1b is approved, he will not be deemed out of status even if their current status was set to expire before October 1st. Otherwise Cap-Gap rule won't apply for him.

Please Verify this 60 days Grace Period with DSO..One of my friend Got out of status when he Applied for OPT STEM extension. His 12 months OPT expired on May 1st 2009. he applied for OPT stem Extension on March. According to 60 days rule should have carried him till July 1 2009. His Extension got denied on June and He became out of status from May 1st 2009.  Strange but true.BTW he never utilised 60 days grace period after his graduation. Started his OPT the following day he graduated.

I think u are OK dude. As someone mentioned earlier, last year they changed the rule. The CAP-GAP rule will automatically maintain ur status till October 1st. But to be one safe side, u can just register some classes as someone said, and drop classes when ur H1B starts. But If i were u i would go to advisor and ask abut it. They usually have all the rules.

Blue Bus i was only emphasizing ur point that cap gap rule will apply if h1b approved..

if it seems 'holier-than-thou' reply..I don't fking care what u think..I am no legal expert but i want to make sure that i present facts and Figures..
