Guys..I got my H1 last year ...went into couple of project also...now I dont have any project on hand.Inbetween the project I stayed on bench without paycheque. In 2009 itself I was on bench for 3 months inbetween the projects.Now my employer is not running my paycheque...they are saying..until i get any new project ..they are not running paycheque.....its 4th month without paycheque...Now the question is ...am i out of status????? Thanks for sugession

I went through the same situation. I was on bench for 6 months in 2003. I was just waiting for new project. Once I got new project for 3 months I immidiately transferred my H1 to other company. So, just wait for new project and do what you like once you get new pay stub.

Thanks Hussain..i heard h1 tranfer will also fail if you stays in bench....So there is no rule for out of status if you are in bench for 5-6 months also right? What about h1 extension...does benching 4-5 months effect on h1 transfer...

Bench does not effect transfer and extension. That does not come in picture. As a matter of fact, to transfer your H1, all you need is latest 3-4 pay stubs.

Are you sure about "bench does not effect transfer and extension"...that's a great news then......So If I go to my native country 2-3 paystub is enough...hope there also benching doen't come into picture..

jairamrai1234 jee. Here is my story in brief. I transfered my H1 after a short project which I got after 6 months on bench. I went to Canada for stamping. I got it done without problem. I landed Canada for my Canadian Green Card. Later my company here in USA applied for Green Card. Everything went fine. 6 months bench never came in picture. Now I am close to citizenship. Hence, stay where u are now until you get new project. Life yestai ho bro. You may be still single which substantially reduces your mental tension.
