NEW DELHI: A 60-year-old Nepalese national has been convicted for attempting to rape a physically and mentally challenged minor girl by a Delhi court but it let him off as he had already spent nearly three-and-half years in jail.
Taking into consideration that the convict was the sole earning member of his large family comprising two wives and eight children, the court took a lenient view and freed him saying that time undergone in jail by him is enough.
"Keeping in view the family background of the convict, a lenient view is taken against the convict Padam Bahadur who is sentenced to rigorous imprisonment for the period already undergone (three years, five months and eight days)," Additional Sessions Judge Kamini Lau said.
The court held Bahadur guilty of the offence of section 376 (rape) read with section 511 (punishment for attempting to commit offences punishable with imprisonment for life or other imprisonment) of the IPC, after he pleaded guilty.
Bahadur pleaded guilty for the crime and apologised for his act before the court, saying he was drunk at the time of incident.
He pleaded that he was a poor person and his family is totally dependent upon him and starving because of his detention for the last more than three years.
Bahadur tried to rape a 13-year-old handicap girl, who was suffering from polio and paralysis, in July 2008 after taking her to his house.
According to the prosecution, Bahadur, who was neighbour of the girl's family in East Punjabi Bagh here, took her to his house on the pretext of giving her something to eat and tried to rape her.
