Does anyone have the experience filing H1b through small company(4-5 employee)? It seems that they know nothing about H1b issues, but have given me words to do the processing next year.
Would anyone suggest me what are the things i should be aware of  such small company regarding H1b process. 
maile bharkhar job start garna lako chhu. so i have no idea regarding this.

My 6 cents!!!
  1. - check if they are E-verified or not
  2. - whats yur current status ? CPT/OPT ?
  3. - consult with their lawyer directly. No need to waste your time with your Manager.
  4. - If they dont have a corresponding HR Dept/lawyer, get more details from a lawyer outside and let your company know about the process/processes.
  5. - Initiattion should be done from yourside provided Statement 4 is valid.
  6. - get this done ASAP. earlier the better in this effing Game of status. you know what i mean?

 Ya it can be done even with small companies. 
And yes e-verification is not required for H1B. It is required only for STEM extension. 

Since there are only 4-5 employyes, it is better if there are no other h1b employees..so check that. If 50% or more are under h1b, it's considered h1 dependent company and needs to provide additional documentation. So check if there are any employees with h1b. If all others are US citizens or residents, its good for u. 

All they need to do is offer you the salary equal to or greater than the minimum prevailing wage for your responsibility which will be obtained once lawyer files prevailing wage application during the process

So get a good lawyer, the lawyer will handle everything. You or your company doesn't need to know everything about the process. All you and your company need to do is provide the information and fees the lawyer asks for.

So just make sure you have decent salary and you job is relevant to your field of study.

THANX sathi haru for ur helpful instructions and thanks ark for making me clear about the e-verification thing. it seems like i need get a lawyer ASAP. I will work on it now. hope everything goes well. :)

 Guys, I've a question,i'mwaiting for my H1b and it seems like i would not get it before my OPT expires!!! Does anyone have similar experience, is there any grace period after an opt expires. So that i can wait for my h1b to arrive. i Have 20 days until my opt expires and my h1b would not be here until end of august. Suggestion plz :)

 So,bagh chal, should I need to find a lawyer now and make him wait till april? Or can the lawyer start the processes now and only filing or whatever should be done in April? Or how does is work?

- This year H1B quota is done. You have to wait till April 1 2013 as Tiger_Walk mentioned above..
- Gather all the necessary documents so that you can apply on April 1 itself. ( if you are proactive/sincere enough, this activity wont take that much i.e ~ 1 week)
- BTW, Happy_Gal is now a Good_Gal by following up on this and taking the matters on her own hands

Here is the deal: On 04/04/2013, email/message me your receipt number for confirmation.


What is a receipt number?
For each H1B visa application, the USCIS assigns a unique 13 digit alphanumeric number. There are 4 USCIS service centers to handle H1B applications. The first 3 character of your receipt signifies the particular service center, where the application is being processed. They can be any one of WAC, EAC, SRC, and LIN.
For example, an application submitted to California state will have a receipt number starting with WAC.

 To nepaliscouser.. 

You need to contact the International Student Center of your school and apply for Cap Gap extension and they will give you new I-20 with your OPT expiry date extended to Sept 30.  You may need to submit the h1b receipt form you obtained from USCIS and the proof that you filed for H1b during regular time which is April.  You need to do so even if you recieve your H1b approval before your OPT expiry since H1b will be valid only from Oct 1.
