Hello I just started a job and need to apply for H1B through the company. The company does not have a lawyer. When do I need to send the documents to USCIS? I heard that April 1 is the day when USCIS accepts application and also heard that it is first come first serve. Could you please tell me when should I apply for it?

If the company does not have a lawyer, you should look for another lawyer who will file h1b on your behalf and who will have all the information about what's reqired. Its not that easy for you to apply yourself. First you have to apply for prevailing wage and then only h1b. April 1 is the day but its not first come first serve. They'll generally receive more application than required and they will go through lottery system for selection.

lawyer is not required for H1b applications.
However ny2 is correct,I would spend that 1500 dollars for a third party lawyer and proceed with the H1b applications. And yes file it on the first day.

Lawyer should do all the homework before April1st and file it in your company's behalf.

Hello Pawan;
I think you may want to file through the attorney. I did the same as i filed through the small company. I tried to file myself for the first time and took me so long to figure things out. Looks easy but it is not. One of my friend screwed up while trying to file by himself. He got RFE, and rejected. So you better spend $1500 and relax. It might gonna cost you if you wanna do by yourself. Its up to you but my suggestions: file with attorney.
