 H1 Visa Stamp in Nepal

Hi guys,

I came to the States on F1 visa and have been on H1 for the last 2 yrs, GC is in process.
My Dilemma is:
1. I skipped a semester (out of status) when 1st came to the States.
2. Got my BS in Engineering with less than 3.0 GPA
3. Took me 7 yrs to finish my BS.

I work for a fortune 100 company as a consultant...making the above avg. salary (don't ask me how I got in!).

Now, I have to go home in an emmergency. Even though my Academic record is not that good, I work for a very reputable company..Do you guys know what are the chances of getting my visa rejected from KTM office. I have heard that H1 visa is the easiest get from there these days.

Any thoughts will be greately appreciated..

Why don't you go to some places like Bahamas, Mexico etc and get stamped before going to Nepal? I think it might help you.

I am not sure though.

Dacoolone,

I just got my H1b visa stamp 2 days ago in Kathmandu.

I did not even submit, college transcripts and certificates.
The inverview questions were also simple.

The main documents were I797 (approval notice), passport, employer's letter. It is good to carry recent W-2s, pay stubs and tax docs just in case they ask.

if they ask about college, how about just show them the Certificates and say you did not bring the transcripts.

1) Employer's Letter: Does it mean job offer letter? Or need to ask another letter from them specially for H1 visa stamp?

Since the quota for H1 is over, and my work permit expires in Feb, do you think it'd be a good idea to go to Nepal and apply for a H1 visa from there next year in April?Or could I do it earlier?
Given that my employer is ready to sponser me.
But then I wouldn't be allowed to work till October right?

This is so confusing

Since your GC application is in process, there might be complications. Check with your lawyer before you step out of the country, as doing so might jeopardize your GC application.

BTW, the fact that you got your H1B shows that your skipping first semester is not an issue anymore. Your grades should not be any concern to those immigration people. Heck, you got a job at Fortune 100 company, right? If the employer in such excellent standing thinks you are good enough to be their employee, then why on earth should an immigration (govt) clerk with probably no or dismal college record judge you.

Hi Dacoolone,
Every one has different experiences, do not fear of anything, the visa officer will just check your current status. There is no difference in applying visa from other country and your home country. However you better consult good lawyers, I heard that if you ask the lawyers in Murthy.com. They are the best immigration lwayers I've heard so far. I dunno about their fees but they are excellent.

If ur on a valid h1 rt now tehre shouldnt be any problem. I know someone who went to nepal after 10 yrs and got stamped for h1 and came back again. He t00k 10 yrs to get his undergraduate degree, skipped few years of school and graduated....ofcourse this all happened before sevis started. He went home got stamped...stayed in nepal for 4.5 mons and just came back last month. Interestingly he had done his h1 thru one of those crooked dhoti agency and did not even have any pay stub. So looking at this, there shouldnt be any problem for ur case. But again its never 100% regardless.

Thanks guys for all your imputs. It's kindda difficult to risk leaving the 'good life' here.

Does anyone know how I can get a visa appointment for KTM office?

Just saw the posting from BornInNewYork regarding Murthy.com - He mentioned that they are the best lawyers but just wanted to assure you that I have dealt directly with them (Sheila Murthy) and I am telling you she is the WORST lawyer I have ever worked with. They are the rip off - believe me.

I do not want to defend them, neither they are my people. As the matter of rip off, the business of lawyer is rip off anywhere especially in the matter of immigration. I totally agree you, however I've heard from aboout 10 different individuals and they told me the success stories. It depends up on you whether to get ripped off or not. But to get your work done you should go through the successful firms. At least they are knowledgable than Nepali Lawyers. If you go to Nepali Lawyers, you also get ripped off more than them but you don't notice that. However I agree your point, but I do still recommend to get consulted by them.

Does anyone know how long it's taking for Visa Appointment these days in Nepal for H1 Visas? I am going around Dashain time, with the holidays and everythig, I am worried that I might not get an appointment on time for me to return back for work..

around 2-3 weeks for appt. in ktm.
even though u work for fortune 100 company, ur H1 may be from other vendors. in that case ur sponsor is the vendor.

No u can't extend OPT, but u can change ur status to H1. this yr is gone, try next yr.

I heard it takes only 7-10 days to get appointment for visa interview these days. But not sure whether it is correct information or not.
