Please help. I have few questions on Labor Certification Process.

1. Prevailing Wage: How to determine Prevailing wage? My job (Civil Engineer) has wage in between Level I (49,000) and Level II (59,000) of my profession. The entry requirement for my Profession is 4, i.e. Minimum Bachelors Degree. I have a MS. I am applying EB-2 w/ position Senior Civil Engineer so that I can qualify for EB-2. Does my prevailing wage need to be at least 59,000?

2. The employer must post notice of the job opportunity for at least ten consecutive business days at a location at office where everybody can see. Is it a must? Do labor department people come to check at office? Any experience?

3. What are the best three additional recruitment steps?

4. What are the information required for placing a job order? Is prevailing wage required before placing jo order to SWA? What are the initial documents required before labor certification?

my take on it:
if your job requires just the bachelors. then even if you have masters you cannot file as EB-2 because job only requires bachelors and no experience. (i.e. EB3). It does not matter what your qualification is but Labor is to prove that they do not have PEOPLE TO WORK with that minimum qualification for that job in that LOCATION for that EMPLOYER.

labor as far as I have understood/known is for the POSITION, EMPLOYER and LOCATION. so even if you do not have Labor in your name you can use it.{if it exists for the POSITION, and LOCATION and of course for the same EMPLOYER}
when you file I-140 { this is where your name is added/assigned to particular LABOR}

Thapap, Job requires Bachelors Degree + Minimum 5 years of Experience or MS

I think the requirement should clearly say they need Masters Degree, if you want to go through EB-2.

The best way is to consult with Immigration Attorney. They will help you with all these things.

How about education and Work experience from Nepal? If a person has a 4 years bachelors Degree and 5+ years of work experience, then can he file EB-2 based job that requires Minimum Bachelors Degree and 5 Years of work experience?

ANS: YOU NEED TO CHECK O'NET TO DETERMINE OF YOUR PW. EB-2 IS FOR EITHER MS DEGREE OR BS WITH 5 YEARS OF EXPERIENCE.

ANS: YOU WILL FILE YOUR LC UNDER PERM. ADDITIONAL RECRUITMENT INVOLVES ONE OF THE FEW STAGES AS OF ONE YOU MENTIONED.

ANS: IT IS NOT REQUIRED THAT PRINT AD SHOULD HAVE INCLUSION OF PWD. THERE IS NO SWA EXIST ANY MORE, YOU WILL FILE YOUR LABOR UNDER PERM - DEPENDING ON THE CENTER EITHER ATLANTA OR IN CHICAGO. YOU CAN SUBMIT PRINT AD AND ASK FOR PWD FROM SWA. REMEMBER YOU ARE NOT SUBMITTING YOUR LC IN SWA, SWA ONLY GIVES THE PWD.

Please help me out. How long it will take to get duplicate labor certification. I concurrently file I-140, I-485, travel document and work permit all in hold beacuse of i have only copy of my labor certification. It's been almost one year. I am just waiting.

A: You will never get your duplicate labor certification, DOL never issues any duplicate labor certification even it is lost in mail or is lost after you received it.

I am not sure what your lawyers are saying, and they are holding you for this. You can invoke FOIA from DOL. Or there is another way where you can file your subsequent docs for your GC.
