Hi visa experts,

I have a question about going back to graduate school full time after being in H1B. I have been in H1B for a year now and want to go back and want to know about people's experience - legal wise- during the change.

More importantly, I heard that if you have initiated green card process then you wont' be eligible for F1 anymore since you won't pass the 'no-intent-to-immigrate' criteria. I want to know how true this is and whether anyone has had exprerienced it.

Any replies appreciated.

Thanks!

Why are you going nuts? 1000 of people cry to change their status from f1- h1 and you want to do the other, this is hilarious! I understand that you want to do your masters... If you have plenty of money to back you up then yeah change it to f1.. BUt if you are good old "i'm by my own" type then join the masters when you are in H1 visa.. you would be eligible to pay instate as you have filed taxes as a resident.. and further more your employer can pay for your tuition too.. take evening classes or online or whatso ever .. .either ways its your choice do what you want to best of luck..

cardinal,
it depends on where you are in your green card step. if you have reached 140 and/or 485 then it may pose some issue. but should not be a big deal.

not a problem as long as you have not violated any immigration laws.

all you have to do is get I-20. go to school. if you want can go back to home country and get F1 visa stamped and come back.

its perfectly okey.

Good luck and wish you all the best.

yekloyatri,
its not about attitude or anything.
there are lot of people who have different priorities. i am sure cardinal's step is a rarest of all. but it is not something unique. Lot of people have done that for various reasons.

after couple of years of working sometimes one would just realize that it is not what he/she wants to do. they might want to get a terminal degree and be a professor.

sometimes one gets so bogged down with american corporate crap. one just wants to get out of it. all depends......

once again
what do i knoe (O:
