About the Speaker:
 
 
Mr. Bishwa Kanta Mainali is by profession a Senior Advocate at the Supreme Court of Nepal. His areas of practice include Constitutional Law, Human Rights Law and Business Law among others.
 
He is the sitting President of Nepal Bar Association since 2007. He has advised the Constitution Drafting Commission in 1990 and the framing of enactments such as Consumer Protection Act, Human Rights Commission Act and amendments to the Constitution of Nepal.

He has also served as the publisher and Editor-in-Chief of "Jan Jagran", a vernacular weekly newspaper. He is a founder member of Nepal Eye Hospital, Nepal Law Society and is affiliated with numerous other organizations.
He holds degrees in Economics and Law from Tribhuwan University, Nepal. He is currently a visiting faculty at Nepal Law Campus.

In this Chhalphal program, Mr. Mainali will focus on the drafting of the new constitution of Nepal and will open the discussion forum to other law-related questions as well.

Thanks Dr Saab for sharing this information.Could you please ask these questions?

 

1)  What happens if CA can not complete writing constitution by 2 years and consitutionally allowed 6 months extension? Will country face consitutionally void situation if Consitution is not written by given time framework?  or do these parties can extend time having consensus among them?

2) If Maoist decide to abstain CA for long time and go for another Aandolan,CA will not have 2/3 majority and deadlock will be created.In that situation,does CA have any right of consitutional ammendment?

3) Can President of Nepal impose emergency and rule nation for certain period of time?

Could we not find some better location? Medford is a little far. MIT or Harvard would have been better. Or even BU. hehe. Je hos, thank you for organizing it.
In any case, I will try to be there. I wish it was some politician instead. We really need to grill these ignorant, corrupted politicians and make them feel ashamed in front of everyone.

Here are your answers given by him.

1. The 601 member CA is sovereign and has the authority to extend the term for the drafting of the constitution as it pleases them.

 2) If Maoist decide to abstain CA for long time and go for another Aandolan,CA will not have 2/3 majority and deadlock will be created.In that situation,does CA have any right of consitutional ammendment?

2. Unless the CA members themselves change the terms (ie; require only a simple majority instead of a supermajority), there is no easy way to approve a new constitution without a full 2/3 majority.  If any group of CA members abstain to not allow the required 2/3, then the process is stalled.

 3) Can President of Nepal impose emergency and rule nation for certain period of time?
3. No.  The President has no powers other than the ability to hold "consultations with the PM in good faith".
